'IGP must resign or face demos'

Several Pakatan Rakyat elected representatives have given Inspector-General of Police Musa Hassan a one-month ultimatum to resign, otherwise he would face nationwide demonstrations.

The ultimatum was issued in response to Musa's strong hint that police personnel be pulled off the streets following criticism over the shooting of teenager Aminulrasyid Amzah in Shah Alam on Monday.

DAP's Segambut MP Lim Lip Eng, with PKR Lembah Pantai MP Nurul Izzah Anwar and Seri Setia assemblyman Nik Nazmi Nik Ahmad handed the police disciplinary board director Abdul Razak Bokhari a memorandum demanding for Musa's resignation. Bukit Aman camp commandant Supt Ali Ahmad received the memo this afternoon.
Lim criticised that Musa's controversial statement "would only undermine the safety and security of the country.” "If it were a deputy minister or politician, he could retract the statement but because he is the chief of police, his statement is unforgivable and irrevocable," said Lim after they handed over the memorandum. He urged Abdul Razak to form a committee to investigate Musa and either advise him to retire or sack him within a month, failing which they will organise mass protests at Bukit Aman and across the nation to demand his resignation.
Nurul Izzah stressed that mass protests would be the last resort, and they intend to use every avenue available to them to push for accountability from Musa. "It's not that we want to do something illegal every time we raise objections, but it's clear cut that if this arrogance is left unchecked, he's going to continue to do this time and again,” said the Lambah Pantai MP. "How many deaths need to occur before there is accountability from the police, especially the police chief?" she asked. Nurul Izzah said the police needs to stop blaming the media for its own shortcomings, and actively improve on them if it is to properly serve the public. "So many times (have I) raised the issue of conflicting statements on the reduction of crime (rates) in Brickfields from January to May of 2008. And they say the same thing: the media was at fault, the media misreported the statements.” "There has to be a stop (to this incompetence). They have to take stock of what are their weaknesses. And where does the buck stop, if not with the IGP? If he himself does not have the readiness and humility to accept blame and implement reform, who else do we look to?" she said.
All three Pakatan Rakyat representatives also brushed aside Musa's earlier statement today that the police were open to having an inquest to clear their name of any wrongdoing in the fatal shooting incident on Monday. Nurul Izzah said if Musa was serious about an inquest, then he should not have jumped the gun in claiming the shooting was done in self-defence, as his premature explanation could be seen as an attempt to influence the outcome of any inquest. "If you want to focus on an inquest, then (just) say you are ready to support an inquest," she said. Nik Nazmi said the only way forward is to push for the formation of an Independent Police Complaints and Misconducts Commission (IPCMC), which was proposed by the Royal Police Commission in 2005. "If (Aminulrasyid's death) is an isolated case, then an inquest would do, but this is not an isolated case so having an IPCMC is key.” "We can have another royal commission but if the government ignores the royal commission, then it's useless," he added.
Musa said earlier today that the police had completed its investigations and handed over the resulting papers to the Attorney-General's office for further action. Attorney-General Abdul Gani Patail however returned the investigation papers, instructing the police to probe the case further.

Teoh Beng Hock's family may file a motion in the coroner's court to have minister Mohd Nazri Abdul Aziz cited for contempt after he called a Thai pathologist a “liar”.
DAP parliamentarian for Segambut Lim Lip Eng told journalists in the Parliament lobby today that this may be done when the inquest into Teoh's death resumes on April 20.
Nazri, the minister in the Prime Minister's Department, had branded Dr Pornthip Rojanasunand a liar after she claimed to have come under 'political pressure' from Malaysia to end her involvement in the inquest.
"Does Nazri have any evidence to back up his claim? If not, doesn't the statement amount to contempt of court?" Lip Eng asked. The MP has filed a notice under Standing Orders 18(2) to debate Pornthip's allegations in the Dewan Rakyat, as a matter of public interest. “The people deserve to know if there is any truth in (her) allegations. Why was she stopped from entering Kelantan earlier this year? What kind of threat would the country be exposed to if we allow her to come? Is she a terrorist or a foreign spy?" he asked.

Meanwhile, DAP MP Lim Lip Eng, who has been assisting Teoh's family since the tragedy, said he believes Pornthip is telling the truth.
“The government is doing this because they are afraid it might effect the Hulu Selangor by-election results,” said the lawyer in a statement. “If they wanted to pressure her, they could have done so much earlier when she first testified. Doing it now shows (there is a) connection to the Hulu Selangor by-election,” he claimed. “I condemn the hidden hand which is putting political pressure to ban Pornthip from testifying, forcing her to choose between ... the Teoh Beng Hock inquest and her forensic investigations into the deaths in Southern Thailand,” said Lim.

In another reaction, lawyer Lim Lip Eng, also acting for the Teoh family, said that the pressure placed on Pornthip via government channels could be due to the coming Hulu Selangor by-election which the Barisan Nasional wants to win from PKR.
"The inquest will be on the 20th and the by-election will be on April 25. There is pressure on the government side as Pornthip would disclose the findings that could give a great impact on them and the MACC," he told FMT.
Lim also expressed his concerns that the Thai pathologist was not allowed into Kelantan to investigate a case related to the massacre in southern Thailand as part of her forensic work. "I want the government to explain to the people why she is not allowed into Kelantan? She is a renowned doctor, why can't she come to Malaysia? We need as much help from her," said Lim.

Welder files suit against govt and cop over alleged brutality

A 42-year-old welder has filed a suit against the Federal Government and police officer Fazrul Hadi Yamin for alleged police brutality. Tong Ket Ming was allegedly assaulted when he was under remand for suspected involvement in an armed robbery on June 28, 2007.

He filed the suit at the High Court registry via the firm Messrs Stella, Lim & Co yesterday. Tong’s lawyer Lim Lip Eng told reporters that his client was seeking general damages and other costs deemed fit by the court.

In Tong’s statement of claim, he alleged that he was handcuffed and arrested at his house in Rawang on July 9, 2007 before his family members including his wife and then three-year-old daughter. After being interrogated, Tong claimed he was brought to the Sentul district police headquarters and was further questioned by Fazrul, who was an officer there. Tong alleged that he was brought to a room where Fazrul attacked him with his hands, elbows, legs, a rubber pipe and also gave him a “flying kick”. On July 16, 2007, the plaintiff was brought to the magistrate’s court for his remand to be extended. When the judge asked him why his face was swollen and injured, Tong explained that the police officers had hit him. Upon his return to the police headquarters, Fazrul and other police officers allegedly assaulted and hurled abusive words at him. Tong was released on bail the next day and was taken to seek medical treatment. As a result of the attacks, Tong claimed he suffered severe physical injuries on his head, face, nose, lips and other areas on his body as well as psychological trauma. He also said that Fazrul and other Federal Government agents had committed contempt of court when they disobeyed the magistrate’s orders on July 10 and July 16, 2007 to give him medical treatment.

Tong was discharged not amounting to an acquittal by the magistrate’s court on Feb 3 this year after an application by the Deputy Public Prosecutor.

Mechanic claims abuse by hypermarket security guards

KUALA LUMPUR: A mechanic here claimed he was manhandled by two security guards of a hypermarket who had wrongly accused him of shoplifting. Soo Long Hwa, 22, who works in Segambut, said he had paid for a pair of pants and was about to leave the hypermarket when he was confronted by the security guards. Soo said the guards asked him for the receipt and when he failed to produce it, one of the guards punched him in the face. Shocked, Soo told them that they could verify his purchase with the cashier. "The guards took me to the cashier who confirmed that I had paid for the pants." It was only then that he was released by the guards.
Humiliated and angry, Soo related his ordeal to Segambut member of parliament Lim Lip Eng the next day. Lim then sent his assistant and Soo to the hypermarket to demand an explanation and compensation from them. "We asked for the CCTV recordings, but they refused. We then asked the store manager for a written apology and compensation for Soo," said Lim.
Although he had since received an apology and a hamper from the hypermarket, Soo said he decided to highlight the matter as he did not want others to face the same situation.
Lim, meanwhile, advised consumers to keep their receipts to prevent untoward incidents. "If anyone should encounter a situation like this, they should immediately lodge a police report. Things like this should not be taken lightly," he said. The hypermarket could not be reached for comment. -- By Noel Achariam

Segambut residents are unhappy with the presence of illegal hawkers along Jalan Dutamas Raya and are demanding that City Hall relocates them. “The illegal hawkers have been a nightmare for us for the past three years," said Menara Duta Residents Association chairman, Andrew Goh. "We have had to put up with their uncleanliness and noise pollution.” He was puzzled to note that a stall was even established within the TNB substation while other hawkers indiscriminately set up stalls right into the back roads of several houses. Another resident, Wee Ping Goh, wonders why the hawkers are allowed to place tables on the road at night. “There have also been several accidents along the stretch as motorists passing through have to put up with indiscriminate parking by the patrons.” Another resident, who declined to be identified, claimed City Hall had torn down the stalls last year. But due to lack of follow up enforcement, the hawkers resumed operations in January.

“I have been receiving complaints from the residents for the past three years and asked City Hall to resolve this issue several times," said Segambut MP Lim Lip Eng, adding that the business activities at Jalan Dutamas Raya originally started with only one foodstall. "I welcome any swift response from the local authority to relocate the hawkers,” he said.

A spokesperson for the City Hall Petty Traders Development and Management Department confirmed they have taken necessary measures in the past. “We are in the midst of taking the necessary action to move the hawkers to a suitable location in Segambut or somewhere near to Jalan Dutamas Raya.”

MCA property decision still pending

The judicial review by MCA challenging the local government's decision to vacate a property in Cheras has been postponed because the judge needs further clarification. The case filed by MCA questioned the legality of the Kajang municipal council's (MPKJ) decision to evict and demolish an MCA building in Batu 11 Cheras that was built on state land. In the Shah Alam High court today, Judge Hinshawati Shariff will hear the clarifications and deliver the judgment on Apr 23 instead.

According to Segambut MP Lim Lip Eng who is representing MPKJ, the lawyer representing MCA, (from SC Lim & Partners), is not here today. “(So) the court has decided to postpone the case in order for the lawyer in charge to appear in front of the judge to clarify,” he explained.

Lawyer Eric Tan Pok Shyong who is also representing MPKJ said that the judge wants to give a chance for parties to speak and clarify before she came into a conclusion.

“It is not a straightforward delivery of decision,” he added.

The decision was supposed to be delivered yesterday, but it was postponed to today as the judge was on emergency leave. It is known that there are many other similar buildings owned by BN component parties that are built on state land. Therefore if the decision is against MCA, the local authorities can now take actions against other BN-owned buildings that are built on state land.
